Wikipedia:Possibly unfree files/2013 November 11
November 11
[edit]- The following discussion is an archived inquiry of the possible unfree file below. Please do not modify it. Subsequent comments should be made on the appropriate discussion page (such as the media's talk page or in a deletion review). No further edits should be made to this section.
The result of the discussion was: Keep, OTRS permission now confirmed for the newer image, I have deleted the older one from the history (see WP:OTRS noticeboard#File:Lisap.JPG January (talk) 20:07, 3 January 2014 (UTC)
- File:Lisap.JPG (delete | talk | history | logs).
- In an edit summary, the uploader wrote this:
“ | This photo should not be deleted. It was given to me by the artist herself as a copyright free photo. You can confirm by viewing the photo on her website. (Listed as copyright free) Her manager can be contacted to confirm as well. | ” |
The edit summary reveals that the uploader isn't the creator of these images. There are two of them in the history; one of them is here without any indication that it wouldn't be protected by copyright. The uploader therefore needs to provide evidence that the images aren't protected by copyright. Stefan2 (talk) 00:25, 11 November 2013 (UTC)

- Hello, according to their website, GCMap is a free service with permission granted to "use, copy, modify, and to distribute" their maps, provided that the copyright notice is visible (Maps generated by the Great Circle Mapper - copyright © Karl L. Swartz.). On the website's FAQ itself, there is a question "May I use the Great Circle Mapper's maps on Wikipedia?" with the answer being yes (as long as copyright notice appears). I suppose I should have listed that under the "Permission" section on the files' description pages. - Also published elsewhere, for example here, so uploader's own work claim is dubious. Might be PD because of age. Stefan2 (talk) 16:21, 11 November 2013 (UTC)

- EXIF says: "Copyright holder Ben Asen Photography" Eeekster (talk) 20:38, 11 November 2013 (UTC)
Mark RBraff (talk) 22:56, 11 November 2013 (UTC)The photo is clear to use. Ben Asen was hired by DPAA and Barry Frey to take a corporate head shot of Mr. Frey in May 2013. The photo is owned by DPAA for use in corporate materials and for press. I am a consultant to DPAA and am fully authorized to use the photo. It has appeared on numerous web sites to accompany stories on DPAA and Mr. Frey. Here is one, for example: http://adage.com/article/media/frey-named-ceo-digital-place-based-advertising-association/241594/Mark RBraff (talk) 22:56, 11 November 2013 (UTC)
- This needs confirmation through OTRS. I have amended the author per the uploader's comment above and tagged it F11 so that the uploader has guidance on how to proceed. January (talk) 17:51, 1 January 2014 (UTC)

- Source is listed as the Toronto Star which is a Canadian publication however the copyright owner is unknown. The non-free tag specifically states that it is believed to be fair use under US law. Mike (talk) 20:46, 11 November 2013 (UTC)
- Note: This image is currently tagged as non-free. If there is a dispute with the rationale, please tag the image with {{dfu}} or list it at WP:Non-free content review. AnomieBOT⚡ 21:18, 11 November 2013 (UTC)
- Confused, please do not delete - Why is this file on this list? This picture was always marked non-free and considered as "fair use", because it is a historic image. No-one as far as I know, has claimed it was free. The original photograph originates from Mohamed Farah, who gave it to the Toronto Star, who printed it, along with Gawker. But we do not know who took the photograph. Alaney2k (talk) 16:56, 12 November 2013 (UTC)
- Indeed; Wikipedia:Possibly unfree files states right in the lede: "This page is for listing and discussing files that are marked as available under a free license or public domain, but have disputed source or licensing information. [...] Files that are tagged with a non-free template should not be listed here." (emphasis added) -- Limulus (talk) 17:32, 12 November 2013 (UTC)
