This image was downloaded from eBay; it carries the watermark that was standard on all of their images until March 2010. (see [1]; see [2]) to see the watermark in action. If the uploader was the actual photographer, he should be able to supply a higher resolution image without the watermark. Moonriddengirl ^(talk) 00:14, 28 August 2010 (UTC)[reply]

Delete: If the uploader has the perfume they (or anyone else) could take a photo and upload it. Being from ebay the only way this could stay would be under a FUR and it already fails Non-free content criteria number 1, No free equivalent - because it can be replaced. uploaded as pd-uk because author unknown, but source given as http://www.aviastar.org/air/england/vickers_warwick.php - Aviastar is rife with copyvios - see Wikipedia:WikiProject Aircraft/Aviastar and there is no evidence where the creators of Aviastar got the photo, and whether is was originally unattributed, or whether any kind of effort has been made to find out who the author is. In addition, photo is definately later than 1939 as claimed by the caption - Only the first prototype was flying then and this definately isn't that (the engines are wrong). Based on the aircraft's colour scheme and the Junkers Ju-52 marked with a roundel in the background, this photo is probably 1945 or later - which would mean that the "unknown author" claim is irrelevant.Nigel Ish (talk) 16:32, 28 August 2010 (UTC)[reply]

I uploaded it. Good catch, and something I should have noticed myself, and that would be conclusive that "PD-UK" does not apply. But if the photo was taken by the RAF or another British government source, it is in the public domain because it was taken more than 50 years ago -- i.e., before 1959 -- unless someone thinks it was taken in 1960 or later. If it's a British government photo -- given the Ju-52 in the photo, it seems likely that this is an end-of-war photo ca. 1945 taken by the British military in the immediate aftermath of German surrender -- then the tag simply needs to be changed from "PD-UK" to the British government tag for works 50 or more years old. Does anyone know how to determine that? (By the way, for all we know, the photo was taken by the U.S. military while the Warwick visited a German airfield occupied by U.S. forces immediately after the war, and always has been in the public domain. That's a stretch, and not what I would think would be the case, but if we are going to engage in deep research on the copyright status we have to consider even less likely possibilities, I suppose.) The Warwick did not enter service until July 1943 and they would all have been camouflaged so as Nigel Ish comments probably from 1945 onwards almost certainly not before 1943 so would not meet the 70 year rule. No evidence that the image was taken by the Royal Air Force or the British Government if it was a foreign base it could have been taken by anybody which is why it really needs a provenance. For this to be public domain the United States, it would have to be PD in the source country in 1996. While it was PD in Italy at that time, I'm really not seeing why we should care- the image was taken in Spain. I don't know whether it's PD- IANAL- I just think we need an explanation that's a little better than "I'd like it to be PD" or "it would make sense if this was PD". The crux of the debate seems to be these points: was the image published in Spain and if so do their laws apply? and can Italy claim this as a national work making it PD?   - No, not really; the crux of the debate is whether, under US law, the "source country" of this file is Spain or Italy. If the source country is Italy, this is PD; if it's Spain, then the current claim is invalid. I'm not seeing any evidence that we should assume it is Italy- this was taken in Spain, afterall.       - I just found this when I wanted to clarify what source country is. (From Wikipedia:Non-U.S._copyrights#Source_country) "The source country of a work is the country in which it was first published. If the work was published simultaneously in more than one country, it is the "country which has the most significant contacts with the work"" This makes it perfectly clear that source country != country in which picture was taken. I don't know if there exist a source claiming "this picture was first published in Italy", but the place it's taken from says it is from the Italian Airforce Archive, who have them on their website. Sandman888, image is sourced to www.barcelonabombardejada.cat which is the big official Catalan website covering the events. The t&c for the website say that images are the property of Generalitat de Cataluña, or of whoever gave G de C permission to use them, and may only be used for non-commercial purposes check my Spanish. I don't believe this is true. My understanding of Italian law is that if a photograph is taken by an employee in the course of their job the copyright rests with the employer (Chapter V, para 88). Since the photo was undoubtedly taken from an Italian bomber or reconnaissance aircraft in the course of the air raid, and from the quality, it was taken using reconnaissance equipment (there's no evidence of vibration, despite being taken from a moving aircraft, suggesting the camera was mounted on the airframe with damping equipment), I would not have thought it unreasonable to assume that the Italian Air Force owned the copyright, which will have expired in 1958.Elen of the Roads (talk) 15:38, 31 August 2010 (UTC)[reply]

No, that doesn't solve anything. As I have said many times, that the Italian airforce own(ed) the copyright is not disputed. Yes, it was taken by and belonged to the Italian Airforce, and yes, it is public domain in Italy, and became public domain there in 1958 (we'll take that as granted). That does not necessarily mean that it is public domain in the USA, unless Italian law is relevant with regards to this template- for it to do so, we would have to demonstrate that it was first published in Italy, and that it was first published prior to 1996. I think you are confusing publication with creation, and not reading the templates correctly. You see, to be PD in Italy it just had to be created, not published. That's a big difference. From template, PD-Italy: "If this image meets the definition of a simple photograph and was created prior to 1976, then it was out-of-copyright in Italy on the date of restoration (January 1, 1996) and is currently in the public domain in the United States." It meet those conditions and therefore is PD in US. The template you linked to does not say that the image had to be published before 1996, only it had to be PD in Italy by then. And it was, just as PD-Italy explains, eventhough I'm not even sure PD-US is giving a full picture of the conditions in those three bullet-points. It certainly would! Good find. I strongly advise you update this page. We can't be certain whether it was published in Italy or not without further research, but, either way, it would seem that the source country is indeed Italy. As it was in the public domain there in 1996, it's public domain in the US. Unless we have any evidence that it was published outside of Italy prior to 1996 (and that this was the first publishing, which seems highly unlikely), I think we can call this case closed.
